Chapter 4: INTELLECTUAL PROPERTY (Part 1)

What is a way that copyright laws can become more effective and clearer to the public?

a.         Copyright has been an issue in the forefront since the printing press.
b.        The Fair Use doctrine governs copyright laws.  
c.       The Fair Use act causes a great deal of confusion in the area of intellectual infringement. 

3.       (Comprehension) Summarize what is being discussed within this chapter?

The advancement of technology has brought raised the issue of copyright infringement dramatically. Before, it was challenging to copy the works of others, and often times for expensive that just purchasing it. With the advent of recording technology, P2P networks, broadband internet and servers that allow. Another issue is there is general apathy among Internet users for copyright laws, as demonstrated by the video below.

4.       (Connections) How does one element in this article specifically relate to Postman (or at times I will ask you to compare to a different article read in class- edit as appropriate)?

Postman argued that all technological change is a trade off, and that is emphasized in Chapter 4 by Baase. New technology allows for users to take their media with them, often for a nominal fee. Also, there is now a plethora of free media available for purchase. Yet with that, money is being taken from the artists.  The artists also receive some benefits also, for example their music is able to reach a larger audience and perhaps generate more tickets sales than they would have seen before. 



5.       (Application) Name a specific example or NEW solution for this type of problem/similar situation in society or that you have experienced – be specific and explain?
 Itunes came up with a wonderful way to allow people to create playlists and download single tracks easily while only paying a nominal fee per song. This helped in the aspect it created a legal outlet for people to still download what they like. According to a recent study an estimate 70% of people age 12-14 are choosing legal ways to download their music. 



According to the above chart, music sales raised in 2008 due to legal online alternative downloads, demonstrating that legal download methods are beneficial. 


6.       (Analysis) Compare one of the situations in this chapter/reading to something that does not relate to computers, technology, or the Internet? Be sure to reference the chapter and your solution. What ideas NEW can you add to the issue that is being presented within the reading?

Illegal file downloads are equivalent to stealing from a store. When a person does not pay for a song or for a  software, they are taking the money from the designer or artist and from the marketplace. Being that the United States is a market-driven economy, taking money out of the market and still receiving a good will drive the market down. A market driven economy is inherently profit driven, and consequently if the profit is take away, there will be no reason to produce the good. As Baase said "the value of intellectual and artistic works comes from creativity, ideas, research, skill, labor". These efforts need to be rewarded or else the reason to publish will be gone.

 Absolutely there is a need for people to be more aware of the copyright laws and there needs to be a way to enforce them. Money is being take from the artists I discussed here: 

Also, as Baase pointed out, there are further issues than copyright issues, for example the purchasing of search words to provide advertisements when these words are searched. This proves to be an issue when companies buy words of other companies and prevent the from being displayed in search results. There is a case filed in 2009, Rosetta Stone vs Google that is still being tried today.

8.       (Evaluation) Address all that apply. Judge whether or not this topic is relevant in today’s society? Are there any ethical considerations (see Chap1-1.4 for exp of Ethics)?  What new ideas will you make after reading this chapter/article?

 As there are still approximately 26% of downloads coming from Limewire, on illegal file sharing site, the issue is prominent in society. It is crucial that people are aware of what they are downloading and from were; and with that who they are supporting. It is important to understand where your music is coming fromThe topic of illegal downloads is relevant to today’s society as it is becoming increasingly more popular and is being closely watched by the Attorney General. Many colleges are also informing students that they will be punished if caught downloading music on their networks. Unfortunately  it is expensive to regulate illegal downloads, as arresting and prosecuting individuals is costly. It is important to think of the consequences when copy software or downloading music or videos, if it is done illegally it is equivilent to stealing.

a.        What new conclusions have you come to about this topic ?

It is ethically irresponsible to download music files illegallyThere is no difference from stealing an album from a store, or illegally downloading it from Limewire, the effects on the market are equivalent.

 What is a way that copyright laws can become more effective and clearer to the public?

It would be helpful to the public if The Fair Use laws were utilized in a consistent and predictable manner. Baase wrote about the Sony case regarding taping of shows to watch at a later time; this case was ruled as legal. Then there was the Zediva case that rented DVDS to the public and sent them a digital copy, as opposed to a physical DVD. Zediva lost the case on the grounds that they could have the DVDs played publicly. Companies and the public alike need to be made aware of what the laws are and how they apply to their daily activities.

        Eric Schmidt is at a conference discussing the copyright law in the United States and the importance of intellectual property. Schmidt argues that it would be valuable for consumers to have to pay a fee for access to the information that they are interested in viewing.

       Postman argued the technological change is ecological in that it does not just have singular impact but rather impacts the entirety of society. In the case of copyright infringement there have been significant profit losses as a result of information being freely available on the internet, and it is causing companies to realize they must restructure.

      One example is Netflix, who were able to change the movie industry and provide videos to the public for a small monthly fee. This changed the industry forever, closing many video rental stores

What sparked Tay Zonday to write this?

2.     (Knowledge)Tell three interesting elements of this chapter:
a.       Tay Zonday wants to be able to make his material affordable to the masses but says   that he would appreciate making money off the large companies.
b.       If you read through a few of the comments in the Elmo version, some people do not realize that the video was originally written by Tay Zonday.
c.        Tay Zonday is an example of just how connecting the web is.

Tay Zonday wrote a song and published it on YouTube, where it has been repurposed many times and published on to YouTube. This has allowed other users to gain popularity off his incredible success.

As Postman says, technological change is ecological, and has far reaching effects beyond what it is intended. Mediums such as YouTube allow users to create and recreate information with the capability of reaching a large audience.

For example, if you search YouTube for covers of any popular song of your choice, you are likely to receive hundred of results. People use the works of those who have more notoriety than them to aid in reaching a larger audience.

What are other artist’s views on companies such as Napster?
What are other outlets for artists to make money aside from record sales?

2.     (Knowledge) Tell three interesting elements of this chapter:
a.        The argument presented that the industry has been controlled by big business and that Napster is giving the control back to the artist’s and the fans.
b.       Lars Ulrich claims it is not about the money, yet the whole issue is on who is profiting of these distributed works.
c.       The idea from Chuck D that there could be a solution were consumers obtain music for free, but artists are still able to make money.

Napster is a company that allows people to upload music files and then allows others to download them free of charge. This has caused a shift in the music industry and how people obtain music. Lars of Metallica is speaking out against Napster and argues that people do not have the right to their music tracks without purchasing them. Chuck D says that Napster is where in music industry is headed and it is the job of the artists to role with the punches.
4.     (Connections) How does one element in this article specifically relate to Postman (or at times I will ask you to compare to a different article read in class- edit as appropriate)?
According to Postman, there are winners and losers in every technological change. In the instance of Napster people are able to obtain free music, while young artists are able to provide their music to the public. The losers are the artists that are having their work stolen and are unable to make a product from it.

Companies such as Spotify have provided a solution for both artists and users. Spotify allows users to pay ten dollars a month, and with that they are able to create and download playlists, or listen to online radio.

a.        The idea that free music allows people to gain notoriety without the chains of a record label.
b.       There were 2 billion track sales through iTunes while there are an approximate 15 billion illegal downloads.
c.        People are willing to pay for the music they want, if they are given a model which is conducive to their use patterns.
3.       (Comprehension) Summarize what is being discussed within this chapter?
The illegal music download software industry is wreaking havoc on the ability of artist ability to generate revenue through record sales, while lesser known artists are being afforded the opportunity to gain popularity.

According to Postman, there are winners and losers in every technological change. In the instance of illegal download people Jonathon Coleten was able to quit his day job and make music as a result of his ability to provide free music. The Losers would be those who are already famous and are losing record sales as a result of illegal download.

One solution would be Itunes, a online company that allows users to download songs and create playlists for a small fee.

How is this technology going to be moderated to protect copyright infringements?
2.     (Knowledge)Tell three interesting elements of this chapter:
a.        There will soon be 3d scanners the size of a Smartphone.
b.       The object is built a couple microns thick at a time.
c.        The 3d scanner by Microsoft  was the beginning of the revolution of affordable 3d printers.

2.       (Comprehension) Summarize what is being discussed within this chapter?  
3d printing is becoming more popular, which is causing concern among companies in reference to their intellectual property being infringed upon. 3d printing is becoming more affordable to the masses, for only a couple hundred dollars anyone is able to purchase one.
3.       (Connections) How does one element in this article specifically relate to Postman (or at times I will ask you to compare to a different article read in class- edit as appropriate)?
Postman state the technological change is ecological, meaning that one change can influence many others. The development of the Kinect by Microsoft made 3d scanners one hundredth of the price as they were previously. This made is more affordable for anyone to own a 3d printer, causing concern over copyright law protection.

One solution would be for companies who feel their rights are being infringed upon to sell their intellectual property to those who wish to print it themselves. This allows for the user to still be able to print how they like, while the company adapts to the changing world.

What are the penalties for reposting another’s work while still giving them credit?
2.     (Knowledge) Tell three interesting elements of this chapter:
a.       There is a mindset that everything on the Internet belongs to whoever can access it.
b.       Gaudino never received anything in return for her material being taken.
c.        The difference between referencing a work and using it to create your own opinions is vital in appropriate conduct on the internet.

2.       (Comprehension) Summarize what is being discussed within this chapter?  
Guadino had an article she wrote taken and published on Cooks website without permission. This began the topic of the importance of copyright laws and how they are not being respected.
3.       (Connections) How does one element in this article specifically relate to Postman (or at times I will ask you to compare to a different article read in class- edit as appropriate)?
Postman claimed that there are winners and losers to every bit of technological change and this is reiterated in this situation. The winners are the consumers who have readily available information, while the original authors are the losers as they are not receiving any compensation for their work.

I have personally had images stolen from my personal Instagram account and used as advertisements for programs that I have never endorsed. Unfortunately, there was not much of a solution for me except to comment on the photo stating that it was mine and not authorized to use. Instagram allows the reposting of imagery and users must be aware of the information they are providing to the public.

"Chapter 4 Intellectual Property: (Part 1: Intro) "Steal this Film II

1.       (Questioning) After reading this chapter/article what relevant questions do I have?

How is The Pirate Bay able to survive when servers such as Napster have been shut down?


2.       (Knowledge)Tell three interesting elements of this chapter:
a.    The laws in Sweden allowed for The Pirate Bay to be hosted there.      
b.  There has been a 47% decrease in music sales.       
c.   Law enforcement has been faced with the awkward situation of arresting teenagers for illegal downloads.

3.       (Comprehension) Summarize what is being discussed within this chapter?

This issue being discussed in the “Steal This Film” video is that the ease of data sharing is resulting in profit losses from the corporations and people that produce them. For example, the Hollywood industry paid private investigators to investigate The Pirate Bay site as they are hosting a site where people are able to post links to files to be downloaded. The problem with that is that is that the content being distributed is not always legal.At this point I would like to call your attention to a video log by Chris Pirillo, speaking about the dangers inherent with file sharing.


As Chris was describing, there are legal torrents and there are illegal torrents and it is important that the user is aware what they are downloading as to not infringe on any of the copyright laws discussed in “Steal This Film”.


4.       (Connections) How does one element in this article specifically relate to Postman (or at times I will ask you to compare to a different article read in class- edit as appropriate)?



Postman said that there are winners and losers in every new piece of technology developed.  As for file sharing, the winners and the losers are not so clear as a result of the differing interests of people. For example, an Indie artist would be happy to have their work on a file sharing website and may even post it there themselves; while an established pop artists attempting to sell tracks and albums would not want their work available for free download. The losers in the latter situation are the artist, the record label and all others who depend on the purchase of those tracks to continue doing business, the winner in the latter situation would be the consumer as it allows them the ability to obtain free music.
 


5.       (Application) Name a specific example or NEW solution for this type of problem/similar situation in society or that you have experienced – be specific and explain?


      Napster was a peer to peer file sharing network that allowed for the transfer of music files that utilized the computers of other users to connect people to their desired music files. Napster has since been put out of business as a result of lawsuits by artist that were angry at the profit losses they were facing as a result of Napster. Now, Napster is a legal company that hosts a pay for download policy. The Pirate Bay has come under similar attacks but was originally able to escape because of their ability to host in Sweden and the different Swedish laws. In 2013 though, they were forced to begin hosting in Denmark and Spain and sever ties with the Swedish Pirate Party.



6.       (Analysis) Compare one of the situations in this chapter/reading to something that does not relate to computers, technology, or the Internet? Be sure to reference the chapter and your solution. What ideas NEW can you add to the issue that is being presented within the reading?

Illegal file-sharing is similar to to walking into a store and stealing a shirt. In both situations the producer of the good is losing money, while the new owner is gaining something of value to them. Both of these situations are ethically wrong, as something is being taken without any sort of barter. The Pirate Bay provides an outlet for people to steal goods, and others provide the goods to be stolen. 


7.       (Synthesis) Address all that apply. Do you agree with what is being said within the article (Why/Why not? Back up with FACTS, reference)?
I agree with the video as it is important to consider your actions and the effect that they may have on others. In the beginning of the film they showed people aside from the actors and actresses that depend on you purchasing a film, and that is a very valid point.
 If you look at the above chart, the vast majority of people is at the very lease sharing their music files with family members and on average 15%  of people share music files with P2P file-sharing networks. There obviously needs to be a change in the system, whether it involves a change in the music industry profit methods or law officials need to change their methods of catching and prosecution. 



8.       (Evaluation) Address all that apply. Judge whether or not this topic is relevant in today’s society? Are there any ethical considerations (see Chap1-1.4 for exp of Ethics)?  What new ideas will you make after reading this chapter/article?

The topic of file sharing is relevant to today’s society as it is becoming increasingly more popular and is being closely watched by the Attorney General. In fact many colleges are also informing students that they will be punished if caught in an infringement case. Buffalo State College states in their piece about copyright infringement that they receive notice almost every day about infringement that happens on the network. Ethically this poses multiple challenges, first and foremost there is the fact that by participating in illegal file sharing one is stealing. Second, law officials face the decisions of having to arrest and prosecute teenagers that may not have known what they were participating in. Immediately after watching this video I made sure I did not have any P2P programs on my laptop, as I had purchased it from my brother. Before watching Steal This Film, I never considered the consequences for participating in illegal file sharing, or the consequences for those that depend on the purchase of their goods. 


9.       (Conclusion) After completing this assignment, based on new thoughts and evidence
a.        What new conclusions have you come to about this topic ?

I never realized the scope of the problem until watching this film and the further research I completed after. For example, from 2004 to 2009 there have been over 30 billion illegal music downloads. As a result in a decrease of paid for music, there has been a 47% decrease in music sales. The music industry either needs to adapt and find a new profit driver, or authorities need to be given the capital to crack down on the illegal downloads.

How is The Pirate Bay able to survive when servers such as Napster?

The Pirate Bay is sure to keep the servers for their company in countries that do not have laws to enforce on illegal file sharing networks. Since they ran into trouble in Sweden, they moved their servers to Denmark and Spain in order to remain operational.
